If you have been ARRESTED:

- You have the right to a lawyer you choose: call a specialist criminal lawyer.
- You have 8 hours, in which your private lawyer can arrive to help you and the Police must respect your wishes. If you don´t name your own private lawyer, a Duty Solicitor will be appointed to your case.
- You have the right not no declare in front up to Police (if you declare always do so with your lawyer present). In addition, you can answer only the questions you wish if you choose to declare. Afterwards, your statement will pass to the Justice System and you will be passed to declare in front of the Court. Here is it recomended to declare because you would hace been to arrange your defence strategy with your lawyer and also evasive answers before a Judge can lead
- Do not lead the behaviour of the Police or agents of the Justice System intimidate you, also remember: never sign anything without your lawyer having read it previously and being present.
- Never declare anything without the presence of your lawyer.
- Ask for "Habeas Corpus" if you recieve any kind of thread or physical maltreatment or coersion or you believe you have been unjustly or ilegally arrested. If this is the case, they have the legal obligation to take you directly to a Judge.
- You are not obligated to declare anything that may prejudice yourself, if you can´t tell the truth, this is accepted in teh Spanish legal Justice System.


If you have been charged with a CRIME:

Put your defence in the hands of a lawyer specialist in Criminal Law.

If you are called to declare as the defendant, call your criminal lawyer to help you in the interrogation, such as to prepare your answers.

Localise yourself or your family, friends, etc, whatever documentation that could aid your defence and write down the names and whatever other details in order to identify your witnesses.

Remember that a good defence comes when your lawyer is involved from the very begining of your case and can prepare your defence strategy to the maximum level and carry out whatever processes necessary (statements, medical statements, line-ups, etc).


If you have beeb a VICTIM OF A CRIME:

Name yourself as "Private Prosecution Case" when they give you the possibility in the Court, because if you don´t do this, you will only have the proceeding considered of victim and you are not allow to see how your case is pregressing.

You will always have the opportunity to renounce your "private prosecution" care at any time during the legal process without any legal impediment.
